PERSONAL INFORMATION COLLECTION NOTICE

Effective on the date of this notice.

  1. Overview
  • For the purpose of this ‘Personal Information Collections Notice’:
    • Picklr Australia”, “we“, “us“, and “our” means:
      1. the Master Franchisee and its current and future related group companies; and
      2. the Australian Subfranchisees;
    • Master Franchisee” means TPM Partners Pty Ltd ACN 687 497 276;
    • Australian Subfranchisees” means the Master Franchisee’s current and future subfranchises in Australia.
  • We collect your personal information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth).
  • This Personal Information Collection Notice explains how we collect, use and disclose your personal information.
  • Our privacy policy (Privacy Policy) (available here: https://www.thepicklr.au/privacy) contains further details about how we handle your personal information.
  • This Personal Information Collection Notice must be read alongside the ‘Global Picklr Network Consent’ (available here: https://www.thepicklr.au/global-consent)
  1. Who do we collect the personal information from?
  • We collect personal information directly from you when you:
  • apply for or renew a membership;
  • book a court or register for events or programs;
  • make an enquiry or contact us; or
  • use our website or interact with us.
  • The personal information we collect may include:
  • your name, contact details and date of birth;
  • payment and transaction details;
  • membership, booking and participation information;
  • emergency contact details;
  • information about your use of our website; and
  • your interactions with us.
  1. Why do we collect your personal information?
  • We collect your personal information to:
  • provide our services to you, including memberships, court bookings and events;
  • manage our relationship with you;
  • administer activities, competitions and programs (whether delivered by us or through sub-franchisees);
  • respond to enquiries and complaints;
  • communicate important information about our services;
  • improve our services and operations;
  • send you marketing or other communications (unless you have not consented to receive those communications); and
  • provide information to third parties as authorised or required by law.
  • If we do not collect the above personal information, we will not be able to provide you with our services.
  1. Disclosure of personal information

We may disclose your personal information to:

  • service providers (such as booking platforms, payment processors, CRM software and other software systems, IT and marketing service providers);
  • our master franchisor in Australia, and the Australian Sub-franchisees and affiliated operators who deliver services, events or programs in connection with our operations;
  • each authorised Global Picklr Entity, as further described in the Global Picklr Network Consent;
  • professional advisors (such as accountants, auditors and lawyers);
  • if you have consented to the disclosure;
  • where disclosure is necessary to prevent injury to life or health; or
  • if required or authorised by or under an Australian law or court/tribunal order.
  1. Overseas disclosure

We may disclose your personal information to recipients located outside Australia, for example, to the United States, where the head franchisor of the “The Picklr” franchise is based, as well as other entities residing in other foreign jurisdictions within “The Picklr” franchise network, as set out in further detail in the Global Picklr Network Consent.

We will only disclose your personal information overseas if:

  • we have taken reasonable steps to ensure that the overseas recipient of your personal information does not breach the Australian Privacy Principles (APPs);
  • the overseas recipient is subject to a law, binding scheme or binding contract that provides substantially similar protection to the APPs which you can access and enforce; or
  • the disclosure overseas is otherwise required or authorised by law.

If you consent to the disclosure of your personal information to the overseas recipients described in this Personal Information Collection Notice, Australian Privacy Principle 8.1 will not apply to that disclosure.

  • Our Privacy Policy contains information about how you may access your personal information and seek correction of such information as well as how to complain about a breach of the APPs and how we will deal with such a complaint.
